GrapheneDB Privacy Policy

At GrapheneDB, we respect the privacy rights of our users and recognize the importance of protecting the personal information we collect about you. We will never sell personal information, and as a company based in Europe, we carry out all processing operations in strict compliance with European privacy laws. 

We have prepared this Privacy Policy to describe to you our practices regarding the personal data (as defined below) we collect from users of our website located at graphenedb.com and in connection with our GrapheneDB services (the "Services"). In addition, this Privacy Policy tells you about your privacy rights and how the law protects you.

GrapheneDB only collects such Personal Data that is necessary for you to access and use our Services:

    • This information may include your username, first and last name, email address, mailing address, and phone number.
  • Payment Information
    • When you sign up for our Services, you must provide payment and billing information. We do not store full credit card numbers or personal account numbers.

    • IP address (to comply with EU VAT rules for e-services).
  • Log data
    • referring URL and domain, pages visited, geographic location and date and time when website pages were accessed.

2. How will we use your data?

Personal Data we collect from you is used either to respond to requests that you make or to allow us to provide our service to you.

 

  • Providing you with the Service. For example, to register you as a new customer and provide administration of our Services.
  • Billing and collecting payments. This includes sending you emails, invoices, receipts, and communications around your payments. We use a third-party service for secure credit card transaction processing, and we send billing information to that third-party to process your orders and credit card payments.
  • Important system messages. For example, we may inform you by email of temporary or permanent changes to our Services, such as planned outages, service disruptions, and changes to our Privacy Policy.
  • Customer support. We may use your personal information while processing your support inquiries and otherwise to deliver customer service.
  • To improve our Service. For example by asking you to leave a review or take a survey (We won’t disclose with any third party provider).

3. How do we share your data?

GrapheneDB will not sell or rent your Personal Data, but we do disclose your Personal Data to a limited set of trusted Third Parties in the situations explained below, for which you, by using Our Services, hereby explicitly consent.

We may disclose your Personal Data with a small number of Third Party Service Providers which provide important functions to us that allow us to provide you with a better service. For example, amongst others, we have providers that process our credit card transactions and support our internal support system, and manage Our marketing communications. By using GrapheneDB, you explicitly consent to, and authorize us to sub-contract in this manner.

We will obtain assurances that all third-party service providers will safeguard your personal data in accordance with this policy and European privacy laws.

We may disclose Personal Data if we believe in good faith that such disclosure is necessary to comply with relevant laws or to respond to subpoenas or warrants served on us, to protect or defend our rights or property or the rights or property of users of the Products, or to protect against fraud and reduce credit risk.

 

4. How do we store your data?

GrapheneDB’s primary data and servers are hosted at AWS data center in Frankfurt (EU).

GrapheneDB takes strong measures to protect any data that you have submitted to us, especially data that is personal in nature, including profile and financial information. We strive to protect data from loss, misuse, unauthorized access, disclosure, alteration, and destruction.

We have put in place appropriate physical, technical, and administrative measures to safeguard and secure your information, and we make use of privacy-enhancing technologies such as encryption. We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once it is received.

We restrict access to personal information about you to GrapheneDB employees whom we believe reasonably need to come into contact with that information to provide products or Services to you or to do their jobs.

5. Your data protection rights

Under certain circumstances, you may have rights under applicable data protection laws in relation to your Personal Data.

Where applicable, you may have the right to:

  • Request information about how we collect, process, use, and share your Personal Data (commonly known as a “right to know request”).
  • Request access to your Personal Data (commonly known as a “data subject access request”). This enables you to receive a copy of the Personal Data we hold about you and to check that we are lawfully processing it.

  • Object to processing of your Personal Data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms.In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
  • Request restriction of processing of your Personal Data. This enables you to ask us to suspend the processing of your Personal Data in the following scenarios: (a) if you want us to establish the data’s accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
  • Request the transfer of your Personal Data to you or to a third party. We will provide to you, or a third party you have chosen, your Personal Data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

6. Retention of personal information

We will retain your information for as long as your account is active or as long as needed to provide you with our Services. We may also retain and use your information in order to comply with our legal obligations, resolve disputes, prevent abuse, and enforce our Agreements.

 

At any time, you may exercise your rights of access, rectification, cancellation, and opposition to the processing of personal data by sending an email to the contact information below.

 

7. Transfers of Personal Data outside the EEA

GrapheneDB’s primary data servers are hosted in AWS data centers, located in Frankfurt (EU). 

We may share your personal data with a very limited number of third-party service providers in countries outside the EU to permit such parties to provide services that help us with our business activities. 

As we do with all our third-party service providers, we will obtain assurances that they will safeguard your personal data in accordance with this policy and European privacy laws. 

 

8. Dispute Resolution.

If you believe that we have not adhered to this Privacy Policy, please contact us by e-mail at support@graphenedb.com. We will do our best to address your concerns. If you feel that your complaint has been addressed incompletely, we invite you to let us know for further investigation. If we are unable to reach a resolution to the dispute, we will settle the dispute exclusively under the rules of the American Arbitration Association.

 

9. Changes to This Privacy Policy

This Privacy Policy is subject to occasional revision, and if we make any substantial changes in the way we use your Personal Data, we will notify you by sending you an e-mail to the last e-mail address you provided to us or by prominently posting notice of the changes on our website. Any material changes to this Privacy Policy will be effective upon the earlier of thirty (30) calendar days following our dispatch of an e-mail notice to you or thirty (30) calendar days following our posting of notice of the changes on our site. These changes will be effective immediately for new users of our website and Services.

Please note that at all times you are responsible for updating your personal data to provide us with your most current e-mail address. In the event that the last e-mail address that you have provided us is not valid, or for any reason is not capable of delivering to you the notice described above, our dispatch of the e-mail containing such notice will nonetheless constitute effective notice of the changes described in the notice.
